5 SENATE BILL NO. 430 - By: JOLLEY of the Senate and CARGILL of
6 the House.
7 [ eminent domain - Oklahoma Task Force on Recodification of
8 Eminent Domain Statutes - noncodification - emergency ]
9 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
10 SECTION 1. NEW LAW A new section of law not to be
11 codified in the Oklahoma Statutes reads as follows:
12 A. There is hereby created until December 31, 2008, the
13 Oklahoma Task Force on Recodification of Eminent Domain Statutes.
14 The purpose of the Task Force is to review state law governing
15 eminent domain and condemnation, analyze the extent to which
16 statutes in Title 27 and other titles of law relating to eminent
17 domain are in need of recodification and recommend changes to update
18 and recodify Oklahoma statutes to enhance the effectiveness and
19 fairness of Oklahoma laws relating to eminent domain.
20 B. The Task Force shall be composed of twelve (12) members,
21 as follows:
22 1. Two members of the Senate to be appointed by the President
23 Pro Tempore of the Senate;
24 2. Two members of the House of Representatives to be

1 appointed by the Speaker of the House of Representatives;
2 3. Six members to be appointed by the Governor as follows:
3 a. one member who is an attorney knowledgeable on eminent
4 domain procedures in Oklahoma and who represents persons who own
5 property and reside in Oklahoma,
6 b. one member to represent the Oklahoma Municipal League,
7 c. one member to represent the Association of County
8 Commissioners of Oklahoma,
9 d. one member to represent a public utility in Oklahoma,
10 e. one member to represent a rural electric cooperative
11 in Oklahoma, and
12 f. one member to represent the railroad industry in
13 Oklahoma;
14 4. The Director of Oklahoma Department of Transportation or
15 designee; and
16 5. The Attorney General or designee.
17 C. The chair of the Task Force shall be designated by the
18 President Pro Tempore of the Senate and the vice-chair of the Task
19 Force shall be designated by the Speaker of the House of
20 Representatives.
21 D. The Task Force shall meet at such times and in such places
22 as it deems necessary to perform the duties specified in this
23 section. Meetings shall be held at the call of the chair. A
24 majority of the members of the Task Force shall constitute a quorum.
25 E. The Task Force shall present legislative recommendations
26 to the Legislature as it deems necessary.
27 F. The Oklahoma Senate and Oklahoma House of Representatives

1 shall provide staff support as needed by the Task Force.
2 G. Members of the Task Force shall receive no compensation
3 for serving on the Task Force but may receive travel reimbursement
4 as follows:
5 1. Legislative members of the Task Force may be reimbursed
6 for necessary travel expenses incurred in the performance of their
7 duties, in accordance with Section 456 of Title 74 of the Oklahoma
8 Statutes, from the legislative body in which they serve; and
9 2. Other members of the Task Force may be reimbursed for
10 necessary travel expenses incurred in the performance of duties by
11 the respective agency or appointing authorities in accordance with
12 the State Travel Reimbursement Act.
13 SECTION 2. It being immediately necessary for the
14 preservation of the public peace, health and safety, an emergency is
15 hereby declared to exist, by reason whereof this act shall take
16 effect and be in full force from and after its passage and approval.
